Fernando Cluster is taking legal action against Emory University Hospital Midtown in Atlanta, Georgia, for allegedly misplacing a portion of his skull after brain surgery. The hospital’s mistake led to a series of complications, including an extended hospital stay, additional surgeries, and a significant increase in medical bills.
Cluster underwent surgery in September 2022 after suffering a stroke. During the procedure, a portion of his skull was removed and intended to be reattached in a follow-up surgery. However, when the time came for the second surgery, the hospital couldn’t locate Cluster’s bone flap.
The lawsuit claims that the hospital had multiple bone flaps without proper patient identification, making it impossible to confirm which one belonged to Cluster. As a result, a synthetic replacement was created, leading to an infected flap and another surgery.
Cluster incurred $146,000 in medical expenses and has been unable to work since the incident. He and his wife are seeking compensation for their physical and emotional distress.
Emory Hospital has not commented on the ongoing litigation but reaffirmed their commitment to providing high-quality patient care.
